Terms and Conditions

1. Acceptance of Terms

By accessing or using the Monday Auctions platform, including the website, services, or any related features, the user agrees to be bound by these Terms and any policies referenced herein. If the user does not agree to these Terms, they must not use the platform. Monday Auctions LLC is a California limited liability company.

2. Role of Monday Auctions

Monday Auctions operates solely as a digital marketplace that facilitates the listing of vehicles for auction or fixed price sale. The company does not own, inspect, broker, store, transport, or guarantee any vehicle listed on the platform. Monday Auctions does not take possession of vehicles and does not hold vehicle purchase funds. All transactions occur directly between buyers and sellers. Some listings may be promoted as partner listings that link to external sites. Partner listings do not support bidding or checkout on Monday Auctions.

3. User Eligibility

Users must be at least eighteen years old and legally capable of entering into a binding contract. The company reserves the right to suspend or terminate access to the platform for any user who violates these Terms, provides false information, or engages in prohibited conduct.

4. Seller Responsibilities

Sellers agree to accurately describe the vehicle condition, ownership status, and history; provide clear and current photographs; disclose known issues; list vehicles in good faith; ensure the vehicle is free of liens; and complete the transaction promptly once an auction ends or a Buy Today purchase occurs. Misrepresentation may result in removal, suspension, termination, or legal action.

For paid listing types, sellers must complete payment within five business days of approval. Failure to pay will result in listing expiration and removal from the platform.

5. Buyer Responsibilities

Buyers are responsible for reviewing listing details, ensuring funds are available, contacting the seller within seventy two hours of winning, and completing payment and delivery directly with the seller. Failure to comply may result in suspension or removal from the platform.

6. Fees and Payments

All platform fees are processed securely through Stripe and are nonrefundable once charged. Listing fees are charged after admin approval but before the listing goes live.

Weekly Auctions

• Standard Weekly Auction: FREE. Listings are approved by admin and scheduled to go live every Monday at 5:00 AM EST, ending Sunday at 5:00 PM EST. No seller fee.
• Weekly Auction + Featured: $75 listing fee. Approved listings are featured in the homepage carousel and scheduled for the next Monday launch cycle. The Featured fee is due after admin approval and before the listing goes live.
• Reserve Price add-on: +$50. Available for Weekly Auctions only. The vehicle sells only if bidding meets or exceeds the reserve amount.
• Buyer fee: 3% of the final sale price capped at $2,500, charged only if the buyer wins.

Express Auctions

• Listing fee: $50 upfront fee for immediate activation upon payment. Express auctions run for 7 days from activation.
• Buyer fee: 3% of the final sale price capped at $2,500, charged only if the buyer wins.

Buy Today

• Listing fee: $50 upfront fee for a 30-day fixed price listing, activated immediately upon payment.
• Buyer fee: 3% of the final sale price capped at $2,500, charged only if the purchase is completed.

Payment Terms for Sellers

For Express Auctions, Buy Today listings, Featured add-ons, and Reserve add-ons, sellers receive a payment link after admin approval. Payment must be completed within five business days or the listing will expire. The platform sends automated reminders on days one, three, and five.

Vehicle Payment and Delivery

Monday Auctions does not collect vehicle purchase funds. Buyers and sellers handle payment, title transfer, and delivery directly. Users are responsible for ensuring proper title transfer in accordance with their local laws.

7. Prohibited Conduct

Users may not post misleading information, manipulate bids, interfere with transactions, or engage in fraudulent or unlawful behavior.

8. Dispute Resolution

Disputes between buyers and sellers must be resolved directly between the parties. Monday Auctions may provide a mediation service at its sole discretion but is not obligated to do so. The platform may assist with communication or information exchange but does not guarantee resolution.

Any disputes arising from these Terms or use of the platform shall be resolved through binding arbitration in Los Angeles County, California, in accordance with the rules of the American Arbitration Association. Users waive the right to participate in class action lawsuits.

9. Limitation of Liability

The platform is provided as is without warranties of any kind. Monday Auctions disclaims all warranties, express or implied, including merchantability and fitness for a particular purpose. The company's total liability shall not exceed the total fees paid by the user in the twelve months preceding the claim.

10. Indemnification

Users agree to indemnify and hold harmless Monday Auctions LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from platform use, violation of these Terms, or violation of any third-party rights.

11. Privacy and Data

Personal information is handled according to the Privacy Policy available on the platform. By using the platform, users consent to the collection and use of information as described in the Privacy Policy.

12. Amendments

The company may update these Terms at any time by posting the revised Terms on the platform. Continued use after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of California without regard to conflict of law provisions. Exclusive jurisdiction and venue for any disputes shall be in Los Angeles County, California.

14. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
